The CDC Eviction Moratorium has ended. If you have been served with a Summons, plan on attending your court date.
Regular eviction process:
If you are being evicted, there are things you can do!
First, go to court! Second, do not miss your court date – GO TO COURT!
Tell your story to the judge.
If your case is in Oklahoma or Tulsa County, Legal Aid has free lawyers at the courthouse to help low income people facing eviction. For all other counties, please apply for assistance by clicking HERE or call our application line 888-534-5243, Monday through Thursday, 9:00 a.m. to 4:00 p.m.
Bring information (evidence) about your case to show the judge.
- All notices you got about the eviction
- The summons that told you the court date
- A copy of the lease or rental agreement
- Print any communication from the landlord (texts, emails)
- Print pictures of living conditions
- Your record of payments or proof you paid the rent
- Receipts for rent or repairs
- Witnesses you want to judge to hear about:
- Paying your rent
- Poor living conditions
- Repairs you made
- Anything else you want the judge to hear
Be on time for court!
- Get there early! You need extra time to park and go through security
- Get a babysitter or friend to keep your children
- Print text messages or emails to give to the judge
Tips for renters facing eviction:
- Landlords cannot lock you out of your home unless they have a court order. A landlord is not permitted to terminate your utilities.
- If your landlord has an eviction case against you, and you have received a Summons with a court date, it is VERY important that you go to court.
- If you have a court date, you should inform the Court Clerk if you have any of the symptoms associated with coronavirus, including fever, coughing, or shortness of breath. You should also inform the Court Clerk if you have been under quarantine or if anyone in your household has been ordered to quarantine. If any of these apply and you cannot get a continuance of your case, you must attend court as instructed. Failure to attend court could result in eviction.
